Surrey-The City of Surrey has lost its legal bid to retain the RCMP and disband its new municipal police force.
On Thursday, the B.C. Supreme Court dismissed all the city’s claims. In a 27-page ruling, Justice Kevin Loo stated that whether the July 2023 transition order was reasonable or within the minister’s authority, the provincial legislature had the right to enact legislation governing policing in the city, even if its aim was to counteract a legal challenge.
“The provincial legislature is entitled to enact legislation even where its intention is to overcome a legal proceeding, as in this case,” wrote Loo.
Surrey had challenged the B.C. government’s decision in October, leading to a recent five-day hearing in Vancouver.
It is uncertain if this will conclude the contentious issue, as the city might appeal the decision.
B.C. Public Safety Minister Mike Farnworth expressed hope that the ruling would resolve the dispute.
“I think what’s important is the people of Surrey want this over. And this decision certainly indicates that the transition will continue to the Surrey Police Service,” he said.
Farnworth emphasized the need for all parties, including the City of Surrey, to collaborate to ensure a swift and smooth transition.
